Do I need an attorney to use these templates?
These documents are drafted to Texas statutory standards and are designed to be used by business owners directly. That said, every business situation is different, and we recommend having a Texas attorney review the documents before you finalize them — especially the multi-member operating agreement if significant money or multiple owners are involved.
What format do I receive — Word, PDF, or both?
You receive editable Microsoft Word (.docx) files so you can fill in your specific information (LLC name, member names, percentages, etc.). You can then save as PDF for signing. Most documents also include a PDF reference version.
Does this file the LLC for me with the Secretary of State?
No — this package gives you the internal governing documents. You still need to file a Certificate of Formation with the Texas Secretary of State (online at sos.texas.gov, currently $300 filing fee). The Formation Checklist in the package walks you through that process step by step.
What if I already filed my LLC but don't have an operating agreement?
This package works great for that situation too. Texas doesn't require operating agreements to be filed — they're internal documents. You can adopt one at any time after formation.
